We represent both owners and construction firms in a wide variety of construction litigation matters, ranging from cases concerning office buildings, hospitals, shopping center developments and raw land to problems with residences.
We recently concluded major construction defect litigation for the owners of three commercial office buildings. Our client, the condominium owners’ association, represented the dozen owners of office condos in three buildings that had experienced water penetration. The poorly constructed buildings had hidden defects that required removal of the exterior (a stucco-like material) and re-waterproofing. Our clients were pleased with the confidential results, which involved settlements with contractors, subcontractors and other professionals, then separate settlements with the owners’ property insurers to pay for 100% of the renovation costs as well as attorneys fees.
We also frequently represent builders and contractors. In May 2013, for example, we prevailed in a plea in abatement for a construction firm which had been sued by a subcontractor. Last year, we represented a 100 year old family-owned construction company against a recalcitrant insurer, winning summary judgments on critical questions that led to a seven-figure settlement paid to the construction firm. We also helped a different construction firm, straining to keep its doors open after being sued by a major utility, in convincing its insurer to reverse a “no coverage” decision and resolve the matter at the insurer’s sole expense.
